Welcome to OWNZAA. These Terms & Conditions (“Terms”) govern your access to and use of the OWNZAA website, mobile experience and services (together, the “Platform”), operated from Salem, Tamil Nadu, India. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. About OWNZAA

OWNZAA is an online real estate listing marketplace that helps property owners, brokers and builders advertise properties and connect with genuine buyers and tenants across South India. OWNZAA is not a real estate agent, broker or party to any transaction between users. We do not buy, sell, value or guarantee any property, and we do not charge brokerage or commission on any deal concluded between users.

2. Eligibility & Accounts

You must be at least 18 years old and legally capable of entering into a binding contract to use the Platform. You are responsible for the accuracy of the information in your account and for keeping your login credentials secure. You are responsible for all activity that occurs under your account.

3. Listings & Content

If you post a property, you represent that you are the owner or an authorised representative (broker/builder) and that you have the right to list it. You agree to:

• Provide accurate, current and lawful information, photographs and pricing;
• Not post duplicate, misleading, fraudulent or spam listings;
• Not list property you are not authorised to advertise;
• Not include content that is unlawful, offensive, or infringes any third-party rights.

OWNZAA may review, edit, decline or remove any listing that violates these Terms or our policies, at our discretion and without prior notice.

4. Enquiries & Contact

To protect owners, contact details are shared through a contact gate: buyers provide their name, mobile number and city to enquire, and this information is shared with the relevant listing owner so the two parties can connect directly. You agree to use contact details only for genuine property enquiries and not for marketing, spam or any unlawful purpose.

5. Listing Plans, Fees & Payments

Your first property listing is free. Additional listings and premium features are offered through paid plans, the prices of which are shown on the Pricing page and may change from time to time. Payments are processed by our third-party payment partner (Razorpay). By purchasing a plan you authorise the applicable charge. Fees are governed by our Refund Policy.

6. Verification Badge

A “Verified” badge indicates that an owner has submitted identity and/or ownership documents that our team has reviewed. Verification is a trust signal only and is not a guarantee of ownership, title, legality or the accuracy of a listing. You must independently verify all property, ownership and legal documents before entering into any transaction.

7. Acceptable Use

You agree not to misuse the Platform, including by: attempting to gain unauthorised access; scraping or harvesting data; posting malware; impersonating others; circumventing security; or using the Platform for any unlawful, fraudulent or harmful activity.

8. Intellectual Property

The OWNZAA name, logo, design and software are the property of OWNZAA and are protected by law. Content you submit remains yours, but by posting it you grant OWNZAA a non-exclusive licence to display and promote it on and through the Platform.

9. Disclaimers

The Platform and all listings are provided on an “as is” and “as available” basis. Listings are created by users, and OWNZAA does not warrant the accuracy, completeness, legality or availability of any property or information. Any dealing you have with another user is solely between you and that user, at your own risk.

10. Limitation of Liability

To the maximum extent permitted by law, OWNZAA and its team shall not be liable for any indirect, incidental or consequential loss, or for any loss arising from a transaction between users, reliance on any listing, or unavailability of the Platform. Our total liability for any claim relating to the Platform shall not exceed the amount you paid to OWNZAA, if any, in the three months preceding the claim.

11. Indemnity

You agree to indemnify and hold OWNZAA harmless from any claim, loss or expense arising out of your listings, your use of the Platform, or your breach of these Terms.

12. Termination

We may suspend or terminate your access to the Platform at any time if you breach these Terms or our policies. You may stop using the Platform at any time.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Subject to applicable law, the courts at Salem, Tamil Nadu shall have exclusive jurisdiction over any dispute arising from these Terms or the Platform.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted on this page with a revised “Last updated” date. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
