NRI Guide: Buying or Selling Property in Tamil Nadu

Handling NRI property in Tamil Nadu from another country takes planning, but it is very doable. Many NRIs buy a flat for later, sell an old family house, or rent out a home while they live abroad. This guide is for NRIs who want practical, Tamil Nadu-specific steps rather than generic national advice. You will learn what NRIs can buy, how a power of attorney works at the Sub-Registrar office and how to check title remotely. We also cover payments, TDS and repatriation when you sell, and renting out safely.

What NRIs can and cannot buy

NRIs who are Indian citizens can buy residential and commercial property in India. They cannot buy agricultural land, plantation property or farmhouses. This is the general rule under FEMA (the Foreign Exchange Management Act).

  • Generally allowed: flats, independent houses, residential plots, shops and offices.
  • Not allowed: agricultural land, plantation property and farmhouses.
  • Watch out: “farm plots” sold near towns may still be agricultural land in revenue records. Check the land classification in the patta (land revenue record) before you pay anything.

If you hold an OCI card instead of an Indian passport, confirm the rules that apply to you with your bank or an advocate. Inherited property follows separate rules; see our guide to selling inherited property in Tamil Nadu.

Doing it from abroad: power of attorney and registration

Power of attorney basics

A power of attorney (POA) lets a trusted person in Tamil Nadu act for you. Choose someone you trust completely, and keep the powers limited to the specific property and transaction where possible.

A POA signed abroad must be attested at the Indian embassy or consulate, or apostilled, depending on the country. It must then be adjudicated and stamped in India within the prescribed time before it can be used. Ask an advocate in Tamil Nadu to draft it, so the wording suits the Sub-Registrar office.

Registration without travelling

With a valid POA, your attorney can usually complete registration for you. Typically, they will:

  1. Present the POA and the sale deed at the Sub-Registrar office.
  2. Sign and complete the photo and fingerprint steps on your behalf.
  3. Pay stamp duty and fees from funds you provide.
  4. Collect the registered deed and follow up the patta, tax and EB name transfer.

Once the work is done, ask your advocate how to cancel or limit the POA properly.

Checking title remotely

Many checks can start online. You can view the EC (Encumbrance Certificate) and guideline value on TNREGINET, the state registration portal. Patta, chitta and FMB (field sketch) records are on the Tamil Nadu e-services portal.

Online records do not replace an advocate’s review of the original documents. Follow our guide on things to check before buying a property, and:

  • Ask the seller for scans of the title deed and parent documents.
  • Hire an independent advocate in Tamil Nadu for a written legal opinion.
  • Have a trusted person visit the site to check boundaries and possession, or ask for a live video walk-through.
  • Do not pay any advance (token amount) until you have the legal opinion.

Paying for the property

Payments should go through normal Indian banking channels, such as money sent from abroad or funds in your NRE or NRO account. Pay the seller by bank transfer, never in cash, and keep every statement and receipt.

These records matter later. When you sell, your bank and CA will use them to show where the money came from. Many Indian banks also offer home loans to NRIs, usually up to 75–90% of the property value depending on loan size, under RBI limits. Ask your bank about the paperwork, and check the Reserve Bank of India website for current rules.

Selling: TDS, lower-deduction certificate and repatriation

When an NRI sells property, the buyer must deduct TDS (tax deducted at source) from the payment and deposit it with the government. The buyer usually needs a TAN (tax deduction account number) for this, so tell buyers early.

The TDS amount can be higher than the tax you actually owe on your gain. To reduce it, NRIs can apply to the Income Tax Department for a lower-deduction certificate. Apply well before the sale, since it takes time.

After tax is settled, you can repatriate (send abroad) the sale money within RBI limits. Your bank will usually ask for documents, including a CA’s certificate. Rules have changed under the new Income-tax Act, which applies from 1 April 2026, so work with a chartered accountant (CA). You can also check the Income Tax Department website.

Renting it out while abroad

Many NRIs rent out a flat instead of leaving it empty. Treat it like a small business and put everything in writing.

Frequently asked questions

Can NRIs buy agricultural land in Tamil Nadu?

No. Under the general FEMA rule, NRIs cannot buy agricultural land, plantation property or farmhouses. Be careful with “farm plots” or “farm land” offers, because the revenue records may still show agricultural land. Check the land classification in the patta and ask an advocate before paying anything. Inheritance follows different rules, so take advice separately.

Do I have to travel to India to register a property?

Not necessarily. You can give a power of attorney to someone you trust in Tamil Nadu. It must be attested at the Indian embassy or consulate, or apostilled, then adjudicated and stamped in India within the prescribed time. Your attorney can then sign and register the deed at the Sub-Registrar office for you.

How much TDS will the buyer deduct when I sell?

We have not quoted a rate, because it depends on your gain and on current rules under the new Income-tax Act. The buyer must deduct TDS on payments to an NRI seller. If that would be more than your actual tax, apply for a lower-deduction certificate before the sale. A chartered accountant can guide you.

Can I take the sale money back abroad?

Yes, repatriation is allowed within RBI limits once the tax is settled. Your bank will usually ask for proof of how you paid for the property, the sale deed, tax details and a CA’s certificate. Keep all purchase and sale records safe, and speak to your bank before the sale closes.
